It was not my intention to start a controversy re: obtaining dental records. I know what worked in my case.
I filed with OCR on the Dept of HHS and my state dental board after no response from Aspen for three months.
It was OCR who responded in the most timely manner. While it is correct that HIPPA protects our health information privacy it also is the regulation that states we are entitled to a copy of our records.
YOU requesting YOUR records has NOTHING to do with HIPPA. Most states require a COPY of patient records to be provided within a specified period of time.
MOST states give dentists the option of charging a reasonable fee for copying, although most honest dentists (like me) don't charge for them. In reality, most all of your records except your x-rays are of no help to a future dentist.
The bad thing about going to corporate clinics is they are operating illegally in most states anyway. Boards can only discipline dentists, not sleazeball corporate executives that own and operate them.
The Office of Civil Rights (Federal) handles HIPPA violations. Easy to do online. Aspen released my records within 12 days after I filed complaint.
HIPPA covers OTHER PEOPLE accessing your records, NOT YOU.
You might try filing a complaint with your state's dental licensing agency. Go to your state's main web page and find the correct one and you may be able to do it online.
Or, file a complaint with your state's consumer protection agency. Aspen knows you won't be back for more dental work if you want your records, so they will take their time providing it to you---if ever.
File complaints against them. And, of course try to tell everyone to steer clear of Aspen.
