Breach of HIPPA Law

stars-rating-full stars-rating-full stars-rating-full stars-rating-full stars-rating-full
I filled out a HIPPA form to get my dental records from Aspen Dental in Lake Wales Florida, now more than 30 days later I still have not received any records. I called Marie Velez the assistant Manager 3 times and she did not even have the courtesy to return my phone call, I also called corporate and asked them to speed things up and was told there is nothing they can do. All this after I spend well over 6,000.00 dollars for a set of dentures I was never able to even wear. I have no respect for Aspen Dental on a five star rating they get a no star at all.

It was not my intention to start a controversy re: obtaining dental records. I know what worked in my case.

I filed with OCR on the Dept of HHS and my state dental board after no response from Aspen for three months.

It was OCR who responded in the most timely manner. While it is correct that HIPPA protects our health information privacy it also is the regulation that states we are entitled to a copy of our records.

Guest

YOU requesting YOUR records has NOTHING to do with HIPPA. Most states require a COPY of patient records to be provided within a specified period of time.

MOST states give dentists the option of charging a reasonable fee for copying, although most honest dentists (like me) don't charge for them. In reality, most all of your records except your x-rays are of no help to a future dentist.

The bad thing about going to corporate clinics is they are operating illegally in most states anyway. Boards can only discipline dentists, not sleazeball corporate executives that own and operate them.

Guest

The Office of Civil Rights (Federal) handles HIPPA violations. Easy to do online. Aspen released my records within 12 days after I filed complaint.

HIPPA covers OTHER PEOPLE accessing your records, NOT YOU.

Machele Imf

You might try filing a complaint with your state's dental licensing agency. Go to your state's main web page and find the correct one and you may be able to do it online.

Or, file a complaint with your state's consumer protection agency. Aspen knows you won't be back for more dental work if you want your records, so they will take their time providing it to you---if ever.

File complaints against them. And, of course try to tell everyone to steer clear of Aspen.

This is truly amazing even to an experienced dentist like me. I had a college student come in that supposedly had 13 cavities planned for fillings by Aspen, and the cavities did not even exist.

But planning good teeth for extractions is a new low, even for Aspen. Aspen started long ago in Syracuse, New York as a yank-all-teeth-and put-cheap-denture racket. It is hard to shake this sleazy heritage.

Glad you got a second opinion. Would have been a shame to have been butchered and impoverished by this organized crime syndicate.

needed to get a dental ok for a hip replacement surgery ..... started out with free x-rays & exam & finished up $4000 later .... the issue that could have been avoided .... was told a filling needed to be replaced ( I didn't have a issue with that tooth ... " no pain " ) after a couple of tries ( both resulted in tooth pain , the last to the point I couldn't eat ) was told the tooth was to the point at that time , it needed to be pulled .... so out it came ..... will never again have Aspen Dental work on me .....

Just because you had not pain to start with does not mean the tooth was without problem. All it meant was you had no symptoms at the moment. Could have saved a lot of money (and a tooth!) going to an honest and competent private dentist.

Wont give you your money back

stars-rating-full stars-rating-full stars-rating-full stars-rating-full stars-rating-full
Went to Aspen Dental on highway 27/441 in the villages, Florida, to get new dentures. Met with the doctor and decided the best dentures for me are the conforlites. With dental insurance etc my out of pocket was $2000. I gave them my credit card, one swipe and they were paid in full. 4 days later they called and said my dentures are ready. Went into the office to try the dentures and they were made wrong by their lab techs. They remade the dentures, four days later went to try on the dentures. Same problem, falling out of my head. Another mold, another four days and called me back in. Again, would not fit. The dentist adjusted them, relined them, made all kinds of adjustments to no good. He stated he could not do anything else and would refund my money. The receptionist at the desk told me that I would have to wait until Tuesday of the following week for the finance person to come in and give me a refund. OK I waited until Tuesday. Went into the office and told the receptionist that I was there to see the finance person for a refund. Waited 45 minutes for the finance person. I went back to the desk to remind them I had been there for 45 minutes. Finally the finance manager came out and asked me to come to the desk in the back of the office. Went back there, gave them all of my info only to be informed that I would have to wait 4 days for the regional manager to approved the refund. Then up to another 3 days for my bank to approve the transaction. I have never heard of such a thing. Anyway, my point is they will take your money on the spot. Go back for a refund and YOU have to jump through loops and wait for the finance person to tell you no refund and you have to wait for some regional manager, that could take up to seven days to approve the refund. Now, when I gave them my money they immediately swiped the card got their money. When it comes to a refund takes at minimum seven days to get a refund with all kinds of approval. Does not make sense to me. Be aware, NO MORE ASPEN DENTAL. They will take your money and hold it ransom until they are ready to return it. This is not right. All I wanted was a return the same way I paid. I pay immediately, I want a refund immediately

First of all, it is practically impossible to correctly make new dentures in four days. Second, no honest dentist asks for all the copay up front.

Maybe half when they start, half when you get the dentures. Third, your story is typical. A$pen is overindebted and unable to process refund requests on the spot. Their strategy is to stall as long as possible.

You will hear all sorts of excuses in the future. Cannot understand why people like you go to corporate con operations instead of competent independent dentists.

It usually doesn't work out too well. You realize that A$pen is operating illegally in most states, don't you?

Machele Imf

You indicate you paid via a credit card. They have apparently said they would refund the money so wait a reasonable length of time and if nothing then dispute the charge with your credit card company.

At least you did the smart thing and didn't pay with a debit card!

Once you get your refund you might want to alert your dental insurance company of the fact that they apparently paid money for unacceptable dental products for you and that any monies they paid on your behalf should also be refunded to them. If you want good dentures and good dental work, find a dentist in private practice, unaffiliated with a chain dental mill.

Misinformation

stars-rating-full stars-rating-full stars-rating-full stars-rating-full stars-rating-full
Angry At the end if 2018, I called Aspen Dental for a consultation visit. The first thing I ask the receptionist if they work with the type of implants I have (I had them since 1994), her answer was Aspen Dental can work with all kind of implants. I was very happy because I could not find a dentist who work with Novel Biocare implants where I live now. Everything went well I was informed the new dentures will be ready in two to three weeks and the cost will be $5,167.50. I received the new dentures a month later and to my surprise they were unfinished!! The doctor informed me I need to go for a consultation for implants with another doctor so the dentures can be completed, because my implants are so old it was very hard to find the parts. I went for the consultation and the new doctor gave me an estimated treatment plan for $5,923.80 extra. I have 3 months to return my dentures (3 weeks left) and don't know what to do, because the previous ones are broken.

I use Nobel Biocare implants because they are a reliable (but expensive) brand I can always find parts for. Even for the old Nobel implants.

Look, you would not go to a Jiffy Lube to have a jet turbine engine rebuilt. That would be stupid. Going to a sleazeball corporate clinic to service a fine implant system would be just as idiotic. Call Nobel Biocare.

They can probably refer you to a nearby dentist who uses their products. They are the most common implants out there.

Another idea is to find a prosthodontist in your area. Those guys know all the implant systems.

I do not know if you read my whole complaint. I called Aspen Dental and was informed they able to work with my implants I believed them.

Not every body is as knowledgeable as you are, doctor. It will nice if you put your info to report you for treating others like stupid and idiots for not knowing what you know.

Working with implants takes time, specialized knowledge, experience, and top-notch lab support. Aspen has none of these things and never will.

It is a shyster outfit run by Wall-Street crooks designed to take as much money as possible from patients and make them go to experienced dentists to pay again to have the shoddy treatment redone. It has always been so.

Denture failures and bad service

Aspen Dental. Sylvia L Williams Sebring, Florida 33872 To Whom it may concern I am writing this letter because of the experience I have had at the office in Sebring Florida. I and my husband at the time both had new dentures made at this office. My husband has since passed away, but I still go there for my dentures. I have had several issues with my upper dentures having repeated failures. I don’t have the dates, but I am sure if my records have not been altered you will find that I have had a tooth fall out on 2 or 3 different occasions. My denture had a crack appear in the middle of the denture from the front teeth going back to about 10mm. They repaired it with patch material. A few months later the crack happened again, and they repaired it again. Then the 3rd time it happened they fixed it with a mesh insert. Then it happened again with the mesh insert. By this time, I am getting really frustrated but no one seemed to understand my frustration. They did the repair with blue insert that extends beyond the original mesh repair. They told me to come in the next week to see the dentist and gave me an appointment time of 10 AM April23,2019. I arrived for that appointment 10 minutes early and signed in. Then I sat and waited. People kept coming in and being taken into the office and I waited. Finally, after sitting and waiting and hour and a half past my appointment time I finally asked “Who am I supposed to see and Why am I still sitting here at 11:30? The man looked at the schedule then said I will be right back. He came back and said You can come in now. I was furious. They then took me back and said I needed an x-ray. I was not happy and told them so and asked Why? I don’t see why this is necessary. The next thing I know this big dark-haired man from the front took over. I felt like he was there trying to intimidate me because I was upset about the lack of service I was getting and the lack of sympathy for all that has been going on with these teeth. He was arrogant and smart aleck. (The doctor and tech were good to me and answered my questions.) As I was leaving the dark-haired man led me out. I stopped at the front and asked if I was done because I did not know if they were going to charge me for the x-rays or anything. He said I don’t know are you done? At that point I was really fed up with him. I walked out that door into the waiting room and I could hear him through the closed door say sarcastically “thank You have a good day “ This is my 3rd set of dentures and I have never had this much trouble with teeth before. I Have never had anyone treat me like they have since the last episode with a repair. This is the first time this office has been anything but helpful and kind. But it seems like no one is ever there for long always different people.

Aspen's junk dentures cracked and teeth fell out, huh? No kidding, you must be the thousandth person on this forum to describe this happening.

When technicians paid a pittance are rushed making dentures and don't have enough time to clean wax out of teeth before processing, they come out. When cheap cold-cured acrylic is used instead of quality heat-cured resin, dentures cracked. They got your money. They don't care.

They want you gone. Of course there are different employees every time.

No decent employee wants to work for this slimey corporate clinic for long. They quit as soon as they get a better job- like cleaning bathrooms in Waffle House.

Mid-June: announced free veteran dental care. I called 30 min after time on email promising this. Was told Lancaster office doesn't participate. Ok, then. Had infected tooth at about same time. Called office again. Was given appt two weeks from then. Wouldn't do anything sooner. Gave prescription for antibiotics. Ok. I showed up. Xrays & chitchat. $145 or so. Sorry, can't do anything now! What?Come back in two more weeks. Tooth still hurts. More antibiotics. Today tooth was pulled. Finally! I told them what was needed. Less than one-half hour total time today. They could have done it on the first visit, but nooo. They not only milk you, but seem to have no concern for the PAIN that you're going through. One whole month to do what could have been done in less than an hour, tops.

I Had an appointment scheduled for July 1,2019 and confirmed it. The day before they texted me saying we will see you tomorrow. I get there 30 minutes early to fill out new patient paperwork. They tell me I never confirmed so I am now considered a walk-in. Even though I showed them the texts they sent me. I am still sitting in waiting room since 1130. It’s now 1:30 and now they say the X-ray machine is having a problem. They have no empathy about others time. Never again will I be back.

Pissed Cusromer for Aspen Dental

This all started back in 2014 went for the free examine myself and my husband. @ the time after the xray and cleaning the dentist had come in and said I had several teeth that need to be filled. So that was done. And @ the same time my husband had impressions for his dentures. They were made and he had gone back several times to have the sore spots taken care of. Then he had his bottom denture relined and they were ok for a little while. And when I was in the dental office back in Jan. of 2017 I was having some teeth pulled and my husband was sitting in the waiting room and his denture broke right in half. So they fixed them and after a few days went by they broke again, and they fixed them again. After that they broke again so they said they couldn`t fix them again. We went ahead and had paid for the best denture that they had this was done in Oct of 2017. In Jan of 2017 I started having some teeth pulled and had paid up front for my dentures and a partial that was going to be for my bottom plate. So I had worn the temp dentures for my top had been there several times to have them a justed, Them they had told me I needed and oral surgeon to pull 1 of my teeth. So I had gone and the 1st visit to the oral surgeon was $75.00 and then I had to go back about a week later and he pulled the tooth for $275.00. After my top dentures were to be my perm ones they said I needed more oral surgery cause there was some bone that needed to come out. So that was done and then they said that there was a piece of upper lip that the oral surgeon needed to cut off. So after all that I went ahead and had the rest of my bottom teeth pulled and @ that time I wasn`t ready for my perm top denture until my bottoms were healed after 6 months. But before that I had to have more bone on the bottom taken off so the denture would fit. That was done by an oral surgeon, and then the last 6 teeth that were pulled in August of 2017 there was more bone that needed to be taken off, so that was done. So in April of 2018 I was ready for my perm dentures they did the impressions and I finally got them. Well I had been back to them just about every week to have them adjusted and they never fit right, so after many, many visits the office manager came in and said the dentist couldn`t make me happy. So I did get my money back and went to a different dentist and had my dentures made @ the cost of $2,300.00. I now have all the paper work to file a class action suit against Aspen Dental. I had all the information on my cell phone for the Lawyer in Ark and accidentlally deletye it. Is it possible to resend the information to me again? Aspen Dental in Oxford, Alabama is where I and my husband had all the work done. They are a very bad company to deal with. They get you in the door and then tell you, you need a lot of dental work done which I think is very much of a scam. we had spent $7,142.15 there.

The chances of getting a denture that is actually wearable from swindlers like those that run Aspen Dental is about as unlikely as getting a birthday cake made at the local landfill. You went to the wrong place for the job, sweetheart. You went to get something "free" and paid dearly for it.

Why would any badasss dental office need to give anything away for Free. I hate to say it but aspen dental preys on the people most likely to be ignorant of dentistry, the rural and poor.

Also Alabama too. Don't worry, the dentist there will be gone back to his country by the time your lawsuit rolls around.

Having your teeth cleaned is not like taking a car to the car wash. Any good dentist needs to examine your mouth visually and with x-rays to tell the condition of your gums and bones before doing any sort of cleaning.

How is the dentist supposed to know what type of cleaning you need? But I agree, it is ridiculous to have to wait that long. Aspen often triple-books young dentists right out of school. They are always running behind.

Want decent care? Go to a good dentist in private practice instead of an organized crime syndicate like Aspen.

Yeah, Aspen advertises things free, but charges for them. It's their oldest scam. You choose crooks for dental care, and you will get treated dishonestly. No news there!

These sleazebags assume you won't be there unless you confirm. Since they aren't honest, they figure nobody else is.

Their story was probably one big fat lie.

They probably had a patient with a more profitable procedure come in, and they wanted to give that patient preference. Happens all the time at Aspen Gyp Joints Inc.
